The Divorce Process

The simplest way to get divorced is through an Absolute Divorce. It has three requirements:

  1. A legal marriage.

     

  2. One year of living separate and apart with the intention to end the marital relationship.

     

  3. Either the husband or wife must be a resident of North Carolina for at least six months. Once these requirements are met, you’re eligible to file for an absolute divorce. After the divorce judgment is finalized, both parties can legally remarry and have the option to resume their maiden name. It’s important to note that child custody, child support, and other divorce-related matters can be addressed even if the requirements for divorce haven’t been met.
