Establishing Child Support

Child support payments in North Carolina follow a statutory formula. One factor considered is the relative gross monthly income of both parties. Determining income can be challenging if a parent is unemployed, underemployed, or has irregular income. In such cases, we may request the court to “impute” income, assigning a higher income for child support calculations. Imputation of income depends on whether the parent is voluntarily unemployed or underemployed.

Extraordinary expenses, like travel, daycare, health insurance premiums, extracurricular activities, and non-public school costs, are also considered when determining child support.

Modifying Child Support

Parents may seek a modification if there has been a substantial change in circumstances. Common changes include residential schedule adjustments, income changes, or the children’s age. Consultation with an attorney is crucial to determine eligibility for a child support modification.

Enforcing Child Support

When a party fails to make or timely make child support payments, legal action can be taken. Actions may include wage garnishment, where a portion of the party’s paycheck is withheld.
